Deutsche Fassung

This is an English courtesy translation of the German-language original. In the event of any discrepancy or ambiguity, the German version shall prevail.

Section 1 – Scope

(1) These Terms and Conditions govern the use of the mobile application “HustleLeague” (the “App”). HustleLeague is operated as a partnership under German civil law (Gesellschaft bürgerlichen Rechts – GbR) by:

Denis Gritzmann
Thomas-Mann-Straße 11
48485 Neuenkirchen, Germany

Alexej Gorbatschew
Bogenstraße 23
48432 Rheine, Germany

Email: hustleleague.studio@gmail.com (the “Provider”).

(2) The App is directed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB). Use by businesses is excluded.

(3) Deviating, conflicting or supplementary terms of the user shall not become part of the contract unless the Provider expressly agrees to their validity in writing.

Section 2 – Subject Matter / Description of Services

(1) HustleLeague is a self-organisation app that allows users to set daily and weekly goals and to document their completion.

(2) The App additionally offers community features such as groups, chat messages, friendships and a referral system.

(3) The following services are planned but are not yet active at the time these Terms are published and will follow after the App's launch:

Sections 6 to 8 of these Terms apply only from the point in time at which the respective service actually becomes available. We will update these Terms once that is the case.

(4) The basic functions of the App can be used free of charge. Purchasing Coins and taking out a Hustle+ subscription are voluntary, paid additional services.

(5) The Provider endeavours to keep the App permanently available but does not warrant this. Maintenance work, technical faults or requirements of the platform operators (Google, Apple) may lead to temporary restrictions.

Section 3 – Registration and User Account

(1) The App may initially be tried without registration. Use of the remaining functions and permanent preservation of progress require registration of a user account.

(2) The App may only be used by persons aged 16 and over. Paid additional services (purchase of Coins, Hustle+ subscription) are available exclusively to users aged 18 and over.

(3) Truthful information must be provided upon registration. Access credentials must be kept confidential; the user is liable for activities carried out using their credentials insofar as they are responsible for this.

(4) A user account is not transferable.

Section 4 – User Obligations / Community Rules

(1) Within the community features, users undertake not to post content that

This applies to all content that other users can see: usernames, profile pictures, group names and group pictures, group and private messages, join and invitation messages, and messages in duels.

(2) Users can report content and other users that violate paragraph 1 via the report function in the app (for chat messages) or at any time by email to hustleleague.studio@gmail.com. A report should make clear which content or which user it concerns and why it violates these rules. We review reports promptly and, on request, inform the reporting person of the outcome. In addition, users can block other users in the app.

(3) The Provider is entitled to remove content that violates paragraph 1 without prior notice and, in the event of serious or repeated violations, to temporarily suspend or permanently delete user accounts. Affected users are informed of such a measure and its reason, unless legal reasons prevent this, and may object to it by email.

(4) Users are solely responsible for the content they post.

Section 5 – User-Generated Content

(1) The user grants the Provider a simple right, limited in territory and time to the duration of use, to store, reproduce and make available to other users the content they post (e.g., profile pictures, chat messages, group posts), insofar as this is necessary for the operation of the respective feature.

(2) The user warrants that they hold the necessary rights to the content posted.

(3) If a user deletes their user account, their own contributions in group chats (e.g., messages) are deleted in full; they are no longer available to other users.

Section 6 – Virtual Items (“Coins”)

Note: Purchasing Coins for money is not yet active (see Section 2(3)). Until then, Coins can only be earned by using the App.

(1) Coins are a virtual unit of account that cannot be transferred into real money and have no monetary value outside the App.

(2) Items acquired with Coins are purely cosmetic and provide no gameplay advantage within the App.

(3) There is no entitlement to exchange Coins for real money. If a user deletes their user account, unused Coins expire upon deletion. Deletion takes place immediately and in full; the user is informed of this consequence within the App during the deletion process.

(4) With regard to the right of withdrawal when purchasing Coins, Section 8 of these Terms applies.

Section 7 – Premium Subscription “Hustle+”

Note: The subscription is not yet active (see Section 2(3)).

(1) The “Hustle+” subscription unlocks additional features for a recurring fee. The current price and term are displayed before conclusion of the contract in the Google Play Store or Apple App Store.

(2) The subscription renews automatically for the booked term unless cancelled in good time before expiry via the account settings of the respective store provider (Google Play or Apple ID).

(3) Cancellation, management and refunds of subscriptions are handled exclusively via the functions provided by the respective store operator (Google or Apple); the Provider has no direct access to these.

Section 8 – Payment and Right of Withdrawal

Note: Paid purchases are not yet active (see Section 2(3)). This Section applies from the time they are enabled.

(1) All paid purchases (Coins, Hustle+ subscription) are processed via the in-app purchase systems of Google Play or the Apple App Store. Depending on the developer and usage terms of the respective store applicable at the time of purchase, either the Provider or the store operator (Google Ireland Limited or Apple Distribution International Ltd.) may be the contracting party of the respective purchase contract. The terms of the respective store operator apply additionally to the payment process itself.

(2) Consumers generally have a statutory right of withdrawal pursuant to Sections 355, 356 BGB upon conclusion of the contract. This right is directed against whoever is the contracting party of the respective purchase contract under paragraph 1.

To exercise your right of withdrawal, you must inform us or, insofar as the respective store is the contracting party under paragraph 1, the store operator, by means of a clear statement (e.g., by email) of your decision to withdraw from this contract. You can reach us at:

Section 9 – Liability

(1) The Provider is liable without limitation for intent and gross negligence and in accordance with the German Product Liability Act.

(2) For slight negligence, the Provider is liable only in the event of a breach of a material contractual obligation (cardinal obligation), the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which the user may regularly rely; in this case liability is limited to the foreseeable damage typical for the contract.

(3) Liability for damage arising from injury to life, body or health remains unaffected.

(4) Liability for content posted by users within the community features is excluded insofar as the Provider has not adopted such content as its own.

Section 10 – Suspension and Termination

(1) Users can delete their user account at any time via the App settings.

(2) The Provider may terminate the user relationship without notice or suspend the user account for good cause, in particular in the event of repeated or serious violations of Section 4.

Section 11 – Changes to these Terms

(1) The Provider may amend these Terms where this is necessary for legal reasons (e.g., changes in the legal situation or case law) or to adapt to the technical development of the App, and where this is reasonable for the user.

(2) The Provider will inform users of intended changes at least 30 days before their planned entry into force in text form (e.g., by email or in-app notification) and will explain the content and effects of the change.

(3) The amended Terms only become effective if the user actively agrees to them, e.g., by confirming in the App. If the user does not agree, the previous Terms continue to apply. If continuing the user relationship on the previous terms is unreasonable for the Provider, it may terminate the user relationship with 30 days' notice.

Section 12 – Dispute Resolution

We are not willing and are not obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG).

Section 13 – Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the user has their habitual residence remain unaffected.

(2) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
